The press-release on the ninety-ninth session of the Legal Committee (LEG) of the International Maritime Organization (IMO) held from 16 to 20 April 2012

The 99th session of the IMO Legal Committee (LEG 99) was held from 16 to 20 April 2012 at the Headquarters of the International Maritime Organization (IMO).

The work of the Sub-Committee was attended by delegations of 83 member states, 2 associate members, and representatives of 21 international organizations.

The main issues that have been considered by the 99th session of LEG are as follows:

- Monitoring of the implementation of the HNS Protocol, 2010 to International Convention on Liability and Compensation for Damage in connection with the Carriage of Hazardous and Noxious Substances by Sea, 1996 (HNS Convention1996);

- Consideration of a proposal to amend the limits of liability of the Protocol of 1996 to the Convention on Limitation of Liability for Maritime Claims, 1976 (LLMC 76);

- Provision of financial security in cases of abandonment, personal injury to, or death of seafarers in the light of the progress towards the entry into force of the ILO Maritime Labor Convention, 2006 and of the amendments relating thereto;

- Fair treatment of seafarers in the event of a maritime accident;

- Piracy;

- Analysis of liability and compensation issues connected with transboundary pollution damage from offshore exploration and exploitation activities.

During the consideration of the implementation of the HNS Protocol, 2010 to HNS Convention 1996, the issues of the ratification of the Protocol 2010, the location of the Secretariat of the Convention was discussed.

In the course of consideration of a proposal to amend the limits of liability of the Protocol of 1996 to LLMC 76, the Committee supported an increase of limits by 51 per cent in accordance with article 8 of LLMC Protocol 96 and adopted correspondent Resolution (LEG.5(99)). The amendments will enter into force in 2015.

At the consideration of issues regarding the entry into force of the ILO Maritime Labour Convention, 2006 and of the amendments relating thereto the Committee was informed of the status of ratification of the Convention and the actions taken by the ILO to promote ratification of the ILO Convention and its effective implementation. In particular, it was stated that to date, ratification werereceived from 25 States representing over 56 per cent of the world's gross tonnage of ships.

It is expected that ILO Convention will enter into force in the mid-2013.

At the discussion of issues of piracy the reports of some Member States were considered about their national legislation in respect of employment of privately contracted armed security personnel (PCASP) on board ships. It was decided to improve the statistics on the detention of pirates, and giving them to justice.

With regard to issues of liability and compensation, connected with transboundary pollution damage from offshore exploration and exploitation activities, the Committee was of the opinion of the need for further data analysis, to develop guidelines for States concerned with the possible conclusion of bilateral and regional agreements without development a separate international convention on the subject.

The next 100th session of the LEG is scheduled for 15-19 April 2013.

05.06.2013 - 65th session of the IMO Marine Environment Protection Committee (MEPC-65) was held from 13 to 17 May in London at IMO Headquarters

The 65th session of the IMO Marine Environment Protection Committee (MEPC) has considered and agreed the proposed amendments to MARPOL Annex VI Regulation 13 on Nitrogen oxides (NOx) to change the date of entry into force of the requirements of Tier III standards on emissions of nitrogen oxides from marine diesel engines. Earlier, it was envisaged that the Tier III standards on emissions of nitrogen oxides would come into force on 1 January 2016, subject to the sufficiency of the relevant technologies of exhaust gas cleaning marine diesel engines on market.
